The Communiqué on the Classification of Goods and Services for Trademark Applications (TÜRKPATENT: 2026/2) entered into force upon its publication in the Official Gazette dated 26 February 2026.
With this Communiqué, the Turkish Patent and Trademark Office (TÜRKPATENT) has updated the list of goods and services applicable to trademark applications filed in Türkiye, in alignment with the 13th edition of the Nice Classification.
The Communiqué also codifies a classification framework that had already been implemented in practice through TÜRKPATENT’s electronic filing system (EPATS) since early 2026.
Key Classification Changes:
Compared to Communiqué No. 2024/2, the following key classification changes have been introduced under Communiqué No. 2026/2, inter alia:
- Spectacles, sunglasses, contact lenses and boxes, cases, parts and accessories therefor have been transferred from Class 9 to Class 10 as medical or corrective goods, whereas 3D spectacles, protective spectacles and goggles for swimmers, already treated in practice as falling within Class 9, have now been expressly listed in the Class 9 specification.
- Clutch linings have been expressly allocated based on intended use, with clutch linings for land vehicles classified under Class 12, whereas clutch linings for machines and engines, other than for land vehicles, are classified under Class 7.
- Brakes, linings, other than for land vehicles in Class 7 have been amended to brakes and brake linings, other than for land vehicles and remain in the same class.
- Firefighting vehicles have been moved from Class 9 to Class 12 and are now specified as firefighting vehicles by land, air and water.
- Electrically heated socks for non-medical purposes have been reclassified from Class 11 to Class 25, reflecting their nature as clothing items rather than their heating function.
- Tap swirls have been moved from Class 21 to Class 11, reflecting their classification as sanitary or plumbing fittings rather than household utensils.
- Nozzles for sprinkler hoses have been moved from Class 21 to Class 17, as they are considered hose fittings.
- Plant watering cans and heads, strainers and spray nozzles thereof have been expressly included in Class 21.
- Services of arranging and conducting symposiums, conferences, congresses and seminars, while remaining in Class 41, have been consolidated under the same subclass as education and training, life coaching (education).
The Communiqué further stipulates that where an application includes goods and services lists drafted by reference to both Communiqué No. 2024/2 and Communiqué No. 2026/2, the provisions of Communiqué No. 2026/2 shall prevail.
In view of the amendments introduced by Communiqué No. 2026/2, particular attention should be paid to the accurate drafting of goods and services specifications, as alignment with the updated classification list is central to both procedural efficiency and substantive trademark protection.
