CONTRIBUTING TO YOUNG MINDS’ JOURNEY OF DISCOVERING FUTURE POSSIBILITIES

Last week, we had the pleasure of welcoming 8th grade students from Darüşşafaka Schools, together with their teacher, Barış ABİ to our office as part of their Career Exploration Day.

Darüşşafaka Cemiyeti is one of the oldest educational NGOs in Turkey, dedicated to providing equal access to quality education for talented children who have lost one or both parents and come from financially disadvantaged backgrounds, helping them build independent and successful futures.

During the visit, students explored our workplace, learned about different professions, asked questions about career paths, and presented the CVs and videos they prepared about their future plans. We concluded the day with a feedback session together with our HR Director Rabia Kahraman and colleagues Selin Dündar, Şehriban Güçlü Tan, CPA and Sevinç Yurtsever. A special thanks to Gamze Baytur for initiating and organizing this visit.

It was a pleasure to meet such curious and motivated young minds. We are happy to have contributed, even in a small way, to their journey of discovering future possibilities.

KİŞİSEL VERİLERİN İŞLENMESİ VE KORUNMASINA İLİŞKİN ÇALIŞAN ADAYI AYDINLATMA METNİ

Sayın İlgili,

Stock Fikri Mülkiyet Hizmetleri Anonim Şirketi (“Stock”) kişisel verilerinizin gizliliğine ve güvenliğine azami hassasiyet göstermektedir. Bu kapsamda işbu aydınlatma metni (“Aydınlatma Metni”); 6689 sayılı Kişisel Verilerin Korunması Kanunu (“Kanun”) ve ilgili mevzuat çerçevesinde Stock tarafından iş başvurusu yapan çalışan adaylarının işlenen kişisel verilerinin (“Kişisel Veriler”) ne şekilde ve hangi amaçlarla toplandığını, işlendiğini, kimlerle hangi amaçlarla paylaşılabileceğini açıklamaktadır.

“Kişisel Veri(ler)” Kanun’da kimliği belirli veya belirlenebilir gerçek kişiye ilişkin her türlü bilgi olarak tanımlanmakla birlikte, işbu Aydınlatma Metni’nde Stock tarafından veri sorumlusu sıfatıyla işlenen kişisel verileri ifade etmektedir.

Bu kapsamda, Stock tarafından Kişisel Veriler her koşulda aşağıdaki kurallara uygun olarak işlenecektir:
– Hukuka ve dürüstlük kurallarına uygun olarak,
– Paylaşılan kişisel verilerin doğruluğunu ve gerektiğinde güncel halini koruyarak,
– Belirli, açık ve hukuka uygun amaçlar için,
– Burada belirtilen işleme amacıyla bağlantılı, sınırlı ve ölçülü olacak şekilde,
– İlgili mevzuatta öngörülen veya işlendikleri amaç için gerekli olan şartlar ve amaçlar dahilinde.

1. VERİ SORUMLUSUNUN KİMLİĞİ

Bizlerle, özgeçmişinizde veya sair kaynaklarda referans olarak gösterdiğiniz 3. kişilerin bilgilerini paylaşmanız halinde bu kişilerin bilgilendirilmesinin ve kanunen gerekmesi halinde açık rızalarının alınmasının sizlerin sorumluluğunda olduğunu ve ilgili kişilerin aksi yöndeki tüm talep ve iddialarının sorumluluğunun da şahsınıza ait olduğunu önemle belirtmek isteriz.

3. KİŞİSEL VERİLER’İNİZİN TOPLANMA YÖNTEMİ
Kişisel verileriniz aşağıdaki yöntem ve vasıtalarla toplanabilmektedir:
• Yüz yüze mülakat yapılan hallerde, mülakat sırasında;
• Aday tarafından iletilen bilgilerin doğruluğunu teyit etmek amacıyla yapılan kontroller ile Stock tarafından yapılan araştırmalar sırasında;
• Stock’un internet sitesinde yer alan “kariyer” kısmından öz geçmişinizin paylaşılması halinde.

4. KİŞİSEL VERİLER’İNİZİN İŞLENMESİNİN HUKUKİ SEBEPLERİ VE AMAÇLARI
Stock olarak Kişisel Veriler’inizi aşağıda belirtilen amaçlar ve hukuki sebepler doğrultusunda işleyeceğiz:
• Adayların niteliğini, tecrübesini ve ilgisini açık pozisyona uygunluğunu değerlendirmek;
• Gerektiği takdirde, adayların ilettiği bilgilerin doğruluğunun kontrolünü yapmak veya üçüncü kişilerle iletişime geçip aday hakkında araştırma yapmak;
• Başvuru ve işe alım süreci hakkında aday ile iletişime geçmek;
• İlgili mevzuatın gereklerini ya da yetkili kurum veya kuruluşların taleplerini karşılamak; ve
• Stock’un uyguladığı işe alım ilkelerini geliştirmek ve iyileştirmek.

Özel Nitelikli Kişisel Veriler, sınırlı hallerde, Stock için yapılan çalışmalara yönelik gerekli olması ya da yükümlülüklerin yerine getirilmesi için zorunlu olduğu ölçüde ve Kanun’un 6. maddesinin 3. fıkrası uyarınca istisna kapsamında kalmadığı müddetçe ilgili kişinin açık rızasına bağlı olarak işlenecektir. Açık rızaya tabi olunan hallerde, ilgili kişiler açık rızalarını Kanun’un 7. maddesine göre her zaman geri çekme hakkına sahiptir.

Aydınlatma Metni kapsamındaki Kişisel Veriler, Kanun’un 5. maddesinin 2. fıkrasının (a), (c), (ç), (e) ve (f) bentleri uyarınca işlenmekte olup söz konusu Kişisel Veriler’in işlenmesi açık rızaya tabi değildir.

5. KİŞİSEL VERİLER’İNİZİN KİMLERE HANGİ AMAÇLARLA AKTARILABİLECEĞİ
Stock, yukarıda belirtilen kişisel verilerinizi kanundan doğan yükümlülüklere uymak ve/veya iş görüşmesinin olumlu sonuçlanması halinde iş akdi gereğince sorumluluklarını ifa etmek için rızanız alınmadan emniyet birimleri, ilgili bakanlıklar ve müdürlükler ile kanunlarla yetkili kılınan kamu kurumları dâhil üçüncü kişilere aktarabilir veya açıklayabilir. Türkiye’de verilerinizin açıklandığı üçüncü kişilere ve /veya üçüncü kişi kategorilerine ilişkin bilgi her zaman bilginize ve incelemenize açıktır.

Türkiye içerisindeki veri aktarımının yasal dayanakları Kanun’un 8/2 maddesinin (a) bendine istinaden Kanun’un 5/2. maddesinin (a), (c) ve (ç), (e) ve (f) bentleridir.

Ek olarak, Stock’ un elektronik ortamdaki yazışmalar için kullanmakta olduğu sunucular yurt dışında bulunmaktadır. Bu nedenle, Stock’ a ait her türlü araç ile yapmış olduğunuz yazışmalar ve görüşmeler ile kişisel verilerinizi yurt dışına aktarmış olursunuz. Kişisel Verileri’nizi Stock’ a telefon ile ulaşarak veya tercih edeceğiniz sair yollar ile aktarabilmeniz mümkündür.

Aydınlatma Metni’nde sayılan Kişisel Veriler’in gizliliğini ve güvenliğini sağlamak için gerekli tüm idari ve teknik önlemler Stock tarafından alınmakta olup gerekli olandan daha fazla veri aktarımı gerçekleştirilmeyecektir.

Özel Nitelikli Kişisel Veriler, Kanun’un 6. maddesinin 3. fıkrası uyarınca istisna kapsamında kalmadığı müddetçe ilgili kişinin açık rızasına bağlı olarak aktarılabilecektir. Açık rızaya tabi olunan hallerde, ilgili kişiler açık rızalarını Kanun’un 7. maddesine göre her zaman geri çekme hakkına sahiptir. Aydınlatma Metni kapsamında Özel Nitelikli Kişisel Veriler haricindeki diğer kişisel verilerin aktarılması, Kanun’un 8. maddesinin 2. fıkrasının (a) bendi uyarınca açık rızaya tabi değildir.

6. KİŞİSEL VERİLER’İNİZİN SAKLANMA SÜRESİ
Stock tarafından işlenen Kişisel Veriler, işleme amaçlarının gerektirdiği ve yürürlükte bulunan mevzuata uygun sürelerle saklanmaktadır. İş başvurusunda bulunan adayların kişisel verileri başvuru tarihinden itibaren ilk imha periyoduna kadar (en fazla 6 ay) saklanmaktadır. İş başvuru formları, belgeleri İnsan Kaynakları ve Personel Özlük İşleri Birimi tarafından şirketin yurtiçinde bulunan serverında elektronik ortamda saklanmaktadır. Başvuru sırasında alınan veriler ilk imha periyodunda silinir veya yok edilir.

7. İLGİLİ KİŞİLERİN KİŞİSEL VERİLERİ ÜZERİNDEKİ HAKLARININ NELER OLDUĞUNU VE BU HAKLARI NASIL KULLANABİLECEKLERİ

Kanun’un 11. maddesi uyarınca ilgili kişi aşağıda belirtilen haklara sahiptir:
– Kişisel verilerinin işlenip işlenmediğini öğrenme,
– Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
– Kişisel verilerinin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
– Yurt içinde veya yurt dışında kişisel verilerinin aktarıldığı üçüncü kişileri bilme,
– Kişisel verilerinin eksik veya yanlış işlenmiş olması halinde bunların düzetilmesini isteme ve bu kapsamda kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
– Kanun’un 7. maddesinde öngörülen şartlar çerçevesinde kişisel verilerinin silinmesini / yok edilmesini ve bu kapsamda kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
– İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhlerine bir sonucun ortaya çıkmasına itiraz etme,
– Kişisel verilerinin Kanun’a aykırı olarak işlenmesi sebebiyle zarara uğramaları halinde giderilmesini talep etme.

Yukarıda yer alan haklarınızı kullanmak için yazılı olarak 1.Levent Büyükdere Cad. A Blok No.173 Kat:11 Şişli / İstanbul adresine veya stock@hs02.kep.tr kayıtlı elektronik posta adresine elektronik posta yoluyla müracaat edebilirsiniz. Başvurunuzun ayrıca bir maliyeti gerektirmesi hâlinde, Kişisel Verileri Koruma Kurulu (“Kurul”) tarafından belirlenen tarifedeki ücret alınabilecektir.

Başvuruda bulunanın ilgili kişi olması halinde başvuru; ilgili kişinin adını, soyadını, T.C. kimlik numarasını (yabancı uyruklular için pasaport numarasını), cevabın iletilebilmesi için adres bilgilerini ve kimliğini tevsik edici belgeleri içermelidir.

Başvuruda bulunan kişi başkası adına hareket ediyor ise, bu konuda özel olarak yetkilendirilmiş olması ve yetkinin belgelendirilmesi gerekmektedir. Bu durumda başvuru; başvuruda bulunan kişinin ve ilgili kişinin adını, soyadını, T.C. kimlik numarasını (yabancı uyruklular için pasaport numarasını), cevabın iletilebilmesi için adres bilgilerini ve kimliğini tevsik edici belgeleri içermelidir.

Ayrıca ilgili kişiler, Kurul’a şikâyet hakkını kullanmak amacıyla aşağıdaki iletişim bilgileri ile talepte bulunabilirler:

CLARIFICATION TEXT ON PROCESSING AND PROTECTION OF PERSONAL DATA FOR EMPLOYEE CANDIDATE

To whom it may concern,
Stock Fikri Mülkiyet Hizmetleri Anonim Şirketi (“Stock”) shows utmost sensitivity to the privacy and security of your personal data. In this scope, this clarification text on processing and protection of personal data (“Clarification Text”) explains how and for what purposes the personal data of the employee candidate who is applying for a job (“Personal Data”) is collected, processed and shared with third parties by Stock within the scope of the provided services under the Turkish Law on the Protection of Personal Data numbered 6698 (“Law”) and relevant legislation.

“Personal Data” is defined as any information that relates to an identified or identifiable natural person as per the Law. In this Clarification Text, it refers to the personal data processed by Stock acting as a data controller.

In this scope, Stock shall process the Personal Data in accordance with the following principles in any circumstances:
– Lawfully and fairly,
– Accurately and by keeping up to date where necessary
– For specified, explicit and legitimate purposes,
– Adequately, relevant and limited to what is necessary in relation to the processing purposes as mentioned herein,
– By keeping within the scope of the relative legislation or under necessary conditions of data processing and aims for the purposes of processing.

1. THE DATA CONTROLLER’S IDENTITY
The Data Controller is Stock Fikri Mülkiyet Hizmetleri Anonim Şirketi, having its registered office at 1. Levent Büyükdere Cad. A Blok No.173 Kat:11 Şişli / İstanbul, registered at İstanbul Trade Registry with trade registry number 23120 and with MERSİS number 0781014041700014.

2. PERSONAL DATA COLLECTED BY THE DATA CONTROLLER
The following personal data, which are made public by you in your resume, are processed by the Human Resources Department.

CONTENT OF THE COLLECTED PERSONAL DATA

Identity Data Name, surname, date of birth.
Contact Data E-mail address and mobile telephone number.
Professional Experience Data Training and seminars, previous workplaces and work experiences, graduated schools, foreign language knowledge, skills, certificates, professional knowledge.

We recommend that do not include your personal data in your resume other than the above-listed personal data and share with Stock.

We would like to state that if you share with us the information of third parties that you refer to in your resume or other sources, it is your responsibility to inform these people and to obtain their explicit consent if it is required by law, and that you are responsible for all requests and claims to the contrary by the data subjects.

3. METHODS FOR COLLECTING OF PERSONAL DATA
Your personal data may be collected by the following methods and ways:
• In cases where face-to-face interviews are conducted, during interview;
• During the checks to confirm the accuracy of the information submitted by the candidate and researches made by Stock; and
• In cases where your resume is shared on the “career” section of Stock’s website.
4. THE PURPOSES OF AND LEGAL GROUNDS FOR PROCESSING PERSONAL DATA

As Stock, we shall process your Personal Data for the purposes and the legal basis that are mentioned below:
• To evaluate candidates’ qualifications, experience and interest and their suitability for the open position;
• To check the accuracy of the information conveyed by the candidates or to contact third parties and do research about the candidate if necessary;
• To communicate with the candidate about the application and recruitment process;
• To meet the requirements of the relevant legislation or the demands of authorized institutions or organizations; and
• To develop and improve the recruitment principles that Stock applies.

Special Categories of Personal Data shall be processed in limited cases depending on the explicit consent of the data subject and to the extent where it is necessary for the services for Stock or mandatory for fulfilling Stock’s obligations provided that such information is not within the scope of the exception specified in sub-paragraph 3 of article 6 of the Law. In cases where explicit consent is required, the data subject may always withdraw her/his consent according to article 7 of the Law.

Within the scope of this Clarification Text, Personal Data other than Special Categories of Personal Data shall be processed as per sections (a), (c), (ç), (e) and (f) of sub-paragraph 2 of article 5 of the Law and processing of such Personal Data shall not be subject to the explicit consent.

5. TO WHOM AND FOR WHAT PURPOSES YOUR PERSONAL DATA MAY BE TRANSFERRED
In order to comply with the obligations arising from the law and/or to fulfill its responsibilities in accordance with the employment contract, in cases where you are employed by Stock, Stock may transfer or disclose your above-mentioned Personal Data to the security units, relevant ministries and directorates and third parties including public institutions authorized by laws. Information regarding third parties and/or categories of third parties to whom your data has been disclosed in Turkey is always open for your information and examination.

The legal bases for data transfer within Turkey are sections a), (c), (ç), (e) and (f) of sub-paragraph 2 of article 5 of the Law pursuant to section (a) of the sub-paragraph 2 of the article 8 of the Law.

In addition, the servers that Stock uses for electronic correspondence are located abroad. Therefore, you transfer your personal data abroad through correspondence and interviews you have made with all kinds of tools belong to Stock. It is possible to transfer your Personal Data to Stock by contacting via telephone or other ways that you prefer.

All necessary administrative and technical measures are taken by Stock to ensure the confidentiality and security of Personal Data listed in the Clarification Text, and no more data will be transferred than necessary.

Special Categories of Personal Data may be transferred with data subject’s explicit consent if it is not in scope of the exception that is regulated in sub-paragraph 3 of article 6 of the Law. In cases where explicit consent is required, the data subject has the right to withdraw their express consent at any time according to the article 7 of the Law. Transfer of other personal data other than Sensitive Personal Data within the scope of Clarification Text, is not subject to explicit consent according to section (a) of sub-paragraph 2 of article 8 of the Law.

6. RETENTION PERIOD OF YOUR PERSONAL DATA
The Personal Data processed by Stock shall be kept for the periods which the purposes of processing require, specified in the applicable legislation. Personal data of job applicants are kept from the date of application until the first destruction period (maximum 6 months). Job application forms and documents are stored electronically on the Company’s domestic server by the Human Resources. The data received during the application is deleted or destroyed in the first destruction period.

7. THE RIGHTS OF THE DATA SUBJECT ON PERSONAL DATAS AND HOW THEY CAN USE THESE RIGHTS
Within the scope of article 11 of the Law, data subjects have a right to:
– Learn whether his/her personal data has been processed,
– Request information if her/his personal data has been processed,
– Learn the purposes of such processing of personal data and whether processed data is being used in accordance with these purposes,
– Learn the third persons to whom her/his personal data has been transferred within or outside the country,
– Request correction in case the processing of her/his personal data is incomplete or inaccurate and request notifying to the third parties to whom the personal data is transferred,
– Pursuant to the article 7 of the Law, request the erasure or destruction of her/his personal data and request notifying to the third parties to whom the personal data is transferred,
– Object to negative consequences about her/him that is concluded as a result of analysis of the processed personal data exclusively by automatic means,
– Request claim indemnification if she/he suffered damages due to illegal processing of your personal data.

To exercise your above-mentioned rights, please send a mail to 1. Levent Büyükdere Cad. A Blok No.173 Kat:11 Şişli / İstanbul or send an email to stock@hs02.kep.tr in writing. If the conducting of the requests needs any additional costs, such costs will be reflected to the applicants by Stock subject to the price list determined by the Turkish Personal Data Protection Authority (“Authority”).

In case the application made by the data subject directly, the application should contain her/his name, surname, Turkish ID number (passport number for foreigners), address to convey the response and documents evidencing the identity.

In case the application made by third party who acts on behalf of the data subject, such person should be specifically authorized on this matter and should submit any document as a proof of representing her/his authority. In this case, the application should contain the names, surnames, Turkish ID numbers (passport numbers for foreign persons), addresses to convey the response of both the applicant and the data subject and documents evidencing their identities. Moreover, data subjects may send a request to exercise their right to complaint before the Authority with the contact information below:

GİZLİLİK POLİTİKASI

  1. GİRİŞ

Stock Fikri Mülkiyet Hizmetleri Anonim Şirketi (“Stock”) kişisel verilerinizin güvenliğine azami hassasiyet göstermektedir. Bu doğrultuda işbu Gizlilik Politikası (“Politika”); Stock tarafından aşağıda sayılan kişilerin kişisel verilerinin ne şekilde ve hangi amaçlarla toplandığını, işlendiğini ve üçüncü kişilerle paylaşıldığını açıklamaktadır:

  • Gerçek kişi müvekkiller/hizmet alan kişiler ve/veya gerçek kişi potansiyel müvekkiller/hizmet alan kişiler ile tüzel kişi müvekkillerin/hizmet alan kişilerin ve/veya potansiyel müvekkillerin/hizmet alan kişilerin irtibat kişileri;
  • Stock’a mal veya hizmet sağlayan gerçek kişi tedarikçiler ve tüzel kişi tedarikçilerin irtibat kişileri;
  • Stock internet sitesi (“stock.com.tr”) kullanıcıları;
  • İş başvurusunda bulunan ya da irtibata geçen kişiler;
  • Stock’un hakkında Kişisel Veri elde ettiği diğer kişiler.

“Kişisel Veri(ler)” 6698 sayılı Kişisel Verilerin Korunması Kanunu’nda (“Kanun”) kimliği belirli veya belirlenebilir gerçek kişiye ilişkin her türlü bilgi olarak tanımlanmakla birlikte, işbu Politika’da Stock tarafından veri sorumlusu sıfatıyla işlenen kişisel verileri ifade etmektedir.

Stock; işe alım süreçleri, yerine getirdiği hizmetler, gönderdiği bilgilendirme mesajları bakımından ve sair sınırlı hallerde veri sorumlusu olarak hareket etmektedir.

Bu kapsamda, Kanun ve ilgili mevzuat uyarınca, Stock’un veri sorumlusu sıfatıyla Kişisel Veriler’i işlediği konular bakımından Politika’da yer alan bilgiler geçerli olacaktır. Müvekkillerin talepleri doğrultusunda veri işleyen sıfatıyla gerçekleştirilen veri işleme faaliyetleri Politika kapsamı dışındadır. Bu faaliyetler konusunda gerekli bildirimler veri sorumlusu sıfatıyla hareket eden ilgili müvekkiller tarafından yerine getirilmelidir.

Stock tarafından Kişisel Veriler her koşulda aşağıdaki kurallara uygun olarak işlenecektir:

  • Hukuka ve dürüstlük kurallarına uygun olarak,
  • Paylaşılan kişisel verilerin doğruluğunu ve gerektiğinde güncel halini koruyarak,
  • Belirli, açık ve hukuka uygun amaçlar için,

  1. VERİ SORUMLUSUNUN KİMLİĞİ

Özel Nitelikli Kişisel Veriler; sınırlı hallerde, Stock tarafından verilen hizmetler için gerekli ya da yükümlülüklerin yerine getirilmesi için zorunlu olduğu ölçüde ve Kanun’un 6. maddesinin 3. fıkrası uyarınca istisna kapsamında kalmadığı müddetçe ilgili kişinin açık rızasına bağlı olarak işlenecektir. Kişisel Veriler; Stock tarafından, Kanun’un 5. ve 6. maddelerinde belirtilen şartlara uygun olarak, ilgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, meşru menfaatlerin korunması için veri işlenmesinin zorunlu olması veya ilgili kişinin kendisi tarafından alenileştirilmiş olması şartlarıyla işlenmektedir.

  1. KİŞİSEL VERİLERİN SAKLANMA SÜRESİ

Stock tarafından işlenen Kişisel Veriler, işleme amaçlarının gerektirdiği ve yürürlükte bulunan mevzuata uygun sürelerle saklanmaktadır. Kişisel Veriler’in işlenmesini gerektiren amaçların ortadan kalkması halinde, hukuken saklama mecburiyeti bulunan haller saklı kalmak üzere, Kişisel Veriler Stock tarafından re’sen veya ilgili kişinin talebi üzerine silinecek, yok edilecek veya anonim hale getirilecektir.

  1. KİŞİSEL VERİLERİN AKTARILMASI

Stock’a iletilen Kişisel Veriler, sır saklama yükümlülüğü çerçevesinde yalnızca Stock tarafından istihdam edilen avukatlar, marka/patent vekilleri ile diğer çalışanlara ve hizmetlerin yerine getirilmesi için Kişisel Veriler’in paylaşılması zorunlu olan yetkili kurum ve kuruluşlar gibi üçüncü kişilere aktarılabilecektir. Kişisel Veriler Stock tarafından, yukarıda belirtilen hukuki sebepler, veri işleme amaçları ve Kanun’un 8. maddesi çerçevesinde;

  • Sözleşmenin kurulumu, süresi ve ifası boyunca iletişimin sağlanması amacıyla Stock tarafından istihdam edilen avukatlar, marka/ patent vekilleri ve diğer çalışanlara aktarılabilecektir.
  • Müvekkillere danışmanlık hizmetlerinin verilmesi, fikri ve sınai haklarının korunması, patent, ek patent, faydalı model, marka, telif hakkı, yeni bitki çeşitlerine ait ıslahçı hakları, endüstriyel tasarım ve alan adı başvurularının tescili, geçerliliğin sürdürülmesi ve korunması adına başta Türk Patent ve Marka Kurumu, ODTÜ Alan Adı Yönetimi, Kültür Bakanlığı Telif Hakları Genel Müdürlüğü, Tarım ve Orman Bakanlığı, WIPO (Dünya Fikri Mülkiyet Teşkilatı) olmak üzere diğer idari ve adli makamlar nezdinde gerekli tescil başvurularının ve tescil sonrası işlemlerin gerçekleştirilmesi amaçlarıyla Stock tarafından istihdam edilen avukatlar, marka/ patent vekilleri ve diğer çalışanlara ve yetkili kurum ve kuruluşlara aktarılabilecektir.
  • Mevzuattan doğan yükümlülüklerin yerine getirilmesi amacıyla yetkili kurum ve kuruluşlara aktarılabilecektir.
  • Veri kaybının önlenebilmesi için kopyalama/yedekleme yapılması ve sistemsel ve/veya fiziksel güvenlik süreçlerinin yürütülmesi amacıyla teknik bilişim hizmeti alınan tedarikçi ve hizmet sağlayıcılarına aktarılabilecektir. Söz konusu kişiler; Stock ile imzaladıkları sözleşme hükümleri kapsamında, Kişisel Veriler için uygun düzeyde güvenlik sağlamak, Kişisel Veriler’i yalnızca Stock adına kullanmak ve işlemekle yükümlüdür.

Saklama ve arşiv faaliyetlerinin yürütülmesi amacıyla Kişisel Veriler’inizi sunucuları yurtdışında bulunan Microsoft’a ait bir doküman yönetim platformu olan Sharepoint adlı bulut sistemine, yüklemek ve muhafaza etmek suretiyle Kanun’un 9/1. maddesi uyarınca açık rızanıza dayalı olarak aktarılması mümkündür.

Stock’un elektronik ortamdaki yazışmalar için kullanmakta olduğu sunucular yurt dışında bulunmaktadır. Bu nedenle, Stock’a doğrudan e-posta aracılığı ile ulaştığınız hallerde, kişisel verilerinizi yurt dışına aktarmış olursunuz. Stock’a, Kişisel Verileri telefon ile ulaşarak veya tercih edeceğiniz sair yollar ile aktarabilmeniz mümkündür.

Politika’da sayılan Kişisel Verilerin gizliliğini ve güvenliğini sağlamak için gerekli tüm idari ve teknik önlemler Stock tarafından alınmakta olup gerekli olandan daha fazla veri aktarımı gerçekleştirilmeyecektir. Özel Nitelikli Kişisel Veriler, Kanun’un 6. maddesinin 3. fıkrası uyarınca istisna kapsamında kalmadığı müddetçe ilgili kişinin açık rızasına bağlı olarak aktarılabilecektir. Açık rızaya tabi olunan hallerde, ilgili kişiler açık rızalarını Kanun’un 7. maddesine göre her zaman geri çekme hakkına sahiptir. Politika kapsamında Özel Nitelikli Kişisel Veriler haricindeki diğer kişisel verilerin aktarılması, Kanun’un 8. maddesinin 2. fıkrasının (a) bendi uyarınca açık rızaya tabi değildir.

  1. İLGİLİ KİŞİNİN HAKLARI

T.C. Anayasası’nın 20. maddesine göre herkes, kendisiyle ilgili kişisel verilere ilişkin bilgilendirilme hakkına sahiptir. Ayrıca, Kanun’un 11. maddesi doğrultusunda ilgili kişiler aşağıda belirtilen haklara sahiptir:

  • Kişisel verilerinin işlenip işlenmediğini öğrenme,
  • Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
  • Kişisel verilerinin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
  • Yurt içinde veya yurt dışında kişisel verilerinin aktarıldığı üçüncü kişileri bilme,
  • Kişisel verilerinin eksik veya yanlış işlenmiş olması halinde bunların düzetilmesini isteme,
  • Kanun’un 7. maddesinde öngörülen şartlar çerçevesinde kişisel verilerinin silinmesini/yok edilmesini ve bu kapsamda kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
  • İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhlerine bir sonucun ortaya çıkmasına itiraz etme,
  • Kişisel verilerinin Kanun’a aykırı olarak işlenmesi sebebiyle zarara uğramaları halinde giderilmesini talep etme.

İlgili kişiler yukarıda belirtilen haklarını kullanmak amacıyla taleplerini yazılı olarak 1. Levent Büyükdere Cad. A Blok No.173 Kat:11 Şişli/İstanbul adresine veya stock@hs02.kep.tr  kayıtlı elektronik posta adresine elektronik posta mesajı göndermek sureti ile iletebilirler. Söz konusu taleplerin sonuçlandırılmasının ayrıca bir maliyet gerektirmesi halinde, Stock tarafından başvuru sahibinden Kişisel Verileri Koruma Kurulu (“Kurul”) tarafından belirlenen tarifedeki ücret istenebilecektir

Başvuruda bulunanın ilgili kişi olması halinde başvuru; ilgili kişinin adını, soyadını, T.C. kimlik numarasını (yabancı uyruklular için pasaport numarasını), cevabın iletilebilmesi için adres bilgilerini ve kimliğini tevsik edici belgeleri içermelidir.

Başvuruda bulunan kişi başkası adına hareket ediyor ise, bu konuda özel olarak yetkilendirilmiş olması ve yetkinin belgelendirilmesi gerekmektedir. Bu durumda başvuru; başvuruda bulunan kişinin ve ilgili kişinin adını, soyadını, T.C. kimlik numarasını (yabancı uyruklular için pasaport numarasını), cevabın iletilebilmesi için adres bilgilerini ve kimliğini tevsik edici belgeleri içermelidir.

PRIVACY POLICY

  1. INTRODUCTION

Stock Fikri Mülkiyet Hizmetleri Anonim Şirketi (“Stock”) cares about the privacy of your personal data. In this scope, this Privacy Policy (the “Policy”) describes how and for what purposes the personal data of the following persons is collected, processed and shared with third parties by Stock:

  • Natural person clients/service recipient and/or natural person prospective clients/ service recipient and contact persons of the corporate clients/service recipient and/or prospective clients/ service recipient
  • Natural person suppliers or the contact persons of the corporate suppliers which provides goods or services to Stock;
  • Website (“stock.com.tr”) users of Stock;
  • Individuals applying for job positions or contacting with us;
  • Any other individuals about whom Stock obtains personal data.

“Personal Data” is defined as any information that relates to an identified or identifiable natural person as per the Turkish Law on the Protection of Personal Data numbered 6698 (the “Law”). In this Policy, it refers to the personal data processed by Stock that acts as a data controller.

Stock acts as a data controller in relation to recruitment processes, sending informational messages, and other limited circumstances.

In this regard, as per the Law and the relevant legislation, the information indicated in the Policy shall be applicable to the personal data processed by Stock that acts as the data controller. Processing activities carried out further to clients’ instructions and/or requests as a data processor fall outside of the scope of this Policy. Necessary notifications regarding such processing activities should be made by the relevant clients acting as data controllers.

All Personal Data shall be processed in accordance with the following principles

  • Lawfully and fairly,
  • Accurately and by keeping up to date where necessary,
  • For specified, explicit and legitimate purposes,
  • Adequately, relevant and limited to what is necessary in relation to the processing purposes as mentioned herein,

Special Categories of Personal Data shall be processed in limited cases depending on the explicit consent of the data subject and to the extent where it is necessary for the services provided by Stock or mandatory for fulfilling Stock’s obligations provided that such information is not within the scope of the exception specified in paragraph 3 of Article 6 of the Law. In cases where explicit consent is required, the data subject may always withdraw her/his consent according to Article 7 of the Law.

Within the scope of this Policy, Personal Data other than Special Categories of Personal Data shall be processed as per sections (a), (c), (ç), (e), (f) of paragraph 2 of Article 5 of the Law and processing of such Personal Data shall not be subject to the explicit consent.

The Personal Data are processed by Stock in compliance with articles 5 and 6 of the Law provided that such processing shall not violate fundamental rights and freedoms of the data subjects; to the extent such processing is necessary to protect legitimate interests or where data subjects made their data in public.

  1. RETENTION PERIOD OF PERSONAL DATA

The Personal Data processed by Stock shall be kept for the periods which the purposes of processing require, specified in the applicable legislation. In case the reasons for the Personal Data processing no longer exist, the Personal Data shall be deleted, destructed or anonymized ex officio or upon the request of the data subject without prejudice to the cases where it is legally mandatory to retain data.

  1. TRANSFER OF PERSONAL DATA

By virtue of confidentiality obligation, the Personal Data provided to Stock are not disclosed or transferred to persons other than the attorneys, trademark/patent attorney and employees working at Stock and third parties whom the data requires to be shared in order to perform and pursue the Stock’s duties. In this context, Stock may transfer the Personal Data to the receivers listed below for the following purposes within the scope of above-mentioned legal reasons and purposes of data processing as well as Article 8 of the Law:

  • The Personal Data may be transferred to attorneys, trademark/patent attorneys and other employees employed by Stock in order to ensure communication during the establishment, term and performance of the contract.
  • The Personal Data may be transferred to attorneys, trademark/patent attorneys and other employees employed by Stock in order to provide consultancy services to clients, to protect intellectual and industrial rights as well as to ensure the registration, maintenance and protection of application for patents, additional patents, utility models, trademarks, copyrights, plant breeders’ right for new plant varieties, industrial design and domain name before Turkish Patent and Trademark Agency, METU (ODTÜ) Domain Name Management, General Directorate of the Ministry of Culture for Copyrights, Ministry of Agriculture and Forestry, WIPO (World Intellectual Property Organization) and to carry out necessary registration applications and post-registration procedures before other administrative and judicial authorities.
  • The Personal Data may be transferred to authorized institutions and organizations in order to fulfill the obligations that are arising from the legislation.
  • The Personal Data may be transferred to the suppliers and service providers who provide IT services to Stock in order to provide to copy and back up data services for preventing data loss and to carrying out systemic security processes. The said persons are obligated to provide an adequate standard of security for the Personal Data and to use and process them only on the Stock’s behalf.

Your Personal Data may be transferred to document management platform of Microsoft’s cloud system SharePoint whose server is located abroad regarding your explicit consent according to Article 9/1 of the Law in order to store and archive.

In addition, the servers that Stock uses for communication on electronic platform are located outside of Turkey. Therefore, if you contact Stock directly via e-mail, you are transferring your personal data abroad. It is possible to transfer the Personal Data to Stock by contacting via phone or other ways that you prefer.

The Stock takes the all necessary administrative and technical measures to ensure the confidentiality and security of the Personal Data specified in this Policy, and no more data transfers will be made than necessary. The Special Categories of Personal Data may be transferred upon the explicit consent of the data subject provided that such information is not within the scope of the exception specified in paragraph 3 of Article 6 of the Law. In cases where explicit consent is required, data subject may withdraw her/his consent according to Article 7 of the Law. The transfer of the Personal Data other than Special Categories of Personal Data within the scope of this Policy is not subject to explicit consent as per section (a) of paragraph 2 of Article 8 of the Law.

  1. THE RIGHTS OF DATA SUBJECT

As per Article 20 of the Constitution of the Republic of Turkey, everyone has the right to be informed on the personal data concerning themselves. Furthermore, within the scope of Article 11 of the Law, data subjects have a right to:

  • Learn whether his/her personal data has been processed,
  • Request information if his/her personal data has been processed,
  • Learn the purposes of such processing of personal data and whether processed data is being used in accordance with these purposes,
  • Learn the third persons to whom their personal data has been transferred within or outside the country,
  • Request correction in case the processing of his/her personal data is incomplete or inaccurate,
  • Pursuant to the Article 7 of the Law, request the erasure or destruction of her/his personal data and request notifying to the third parties to whom the personal data is transferred,
  • Object to negative consequences about her/him that is concluded as a result of analysis of the processed personal data exclusively by automatic means,
  • Request claim indemnification if he/she suffered damages due to illegal processing of your personal data.

Data subjects may send a mail to 1. Levent, Büyükdere Cad. A Blok No.173 Kat:11 Şişli/İstanbul or an e-mail to stock@hs02.kep.tr in writing in order to exercise above-mentioned rights. If the conducting of the requests needs any additional costs, such costs will be reflected to the applicants by the Law Firm subject to the price list determined by the Turkish Personal Data Protection Authority (“Authority”).

In case the application made by the data subject directly, the application should contain her/his name, surname, Turkish ID number (passport number for foreigners), address to convey the response and documents evidencing the identity.

In case the application made by third party who acts on behalf of the data subject, such person should be specifically authorized on this matter and should submit any document as a proof of representing her/his authority. In this case, the application should contain the names, surnames, Turkish ID numbers (passport numbers for foreigners), addresses to convey the response of both the applicant and the data subject and documents evidencing their identities.
